Lead & Prosper, LLC., doing business as IDEAL AGENT® (“Ideal Agent,” “we,” “our,” or “us”) is a Licensed Real Estate Brokerage and referral platform headquartered in Tampa, Florida. We operate IdealAgent.com, a platform that connects home sellers and buyers with pre-vetted, top-performing local real estate agents.
This Privacy Policy applies to all visitors, registered users, home sellers, home buyers, and real estate agents who interact with our Site or services. It does not apply to the independent real estate agents in our network, who operate under their own privacy practices.
2. Information We Collect
We collect several categories of personal information depending on how you interact with us.
Information You Provide Directly
- Contact Information: Your name, email address, phone number, and mailing address.
- Property Information: Property address, estimated home value, current mortgage status, reason for selling, and desired listing timeline.
- Buyer Information: Desired home location, price range, financing status, and purchase timeline.
- Agent Profile Information: For registered agents — real estate license number, state(s) of licensure, brokerage affiliation, transaction history, and professional references.
- Communications: Emails, phone call records (where permitted by law), chat messages, and feedback you provide to us.
- Testimonials & Reviews: Any content you submit on our Site or third-party platforms referencing our services.
Information Collected Automatically
- Usage Data: Pages visited, time spent on pages, links clicked, and referral source.
- Device Information: IP address, browser type and version, operating system, and device identifiers.
- Location Data: General geographic location inferred from your IP address. We do not collect precise geolocation data.
- Cookies & Tracking Data: Information collected through cookies, pixels, and similar technologies. See our Cookie Policy for details.
Information from Third Parties
- Public real estate databases and MLS records;
- Review platforms such as Zillow, Realtor.com, Google, and Trustpilot;
- Analytics providers, advertising networks, and data enrichment services;
- Real estate licensing authorities for agent verification purposes.
Sensitive Personal Information
We do not collect or process sensitive personal information as defined under the California Privacy Rights Act (CPRA) or comparable categories under other state privacy laws. Specifically, we do not collect: Social Security numbers, driver’s license or passport numbers, financial account numbers, account log-in credentials, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, union membership, genetic data, biometric data used for identification, or information concerning health, sex life, or sexual orientation. If our data practices change in the future, we will update this Privacy Policy accordingly.
3. How We Use Your Information
We use the personal information we collect for the following purposes:

We do not sell your personal information to third parties. We may share your information in the following circumstances:
With Matched Real Estate Agents
When we make a referral match, we share your contact information and property or buyer details with the matched agent so they may contact you to schedule a consultation. This is the core purpose of our service.
With Our Moving Concierge Partner
Where you have provided express written consent at the point of submission, we share your contact information with our designated moving concierge partner, Infinity Sales Group, so that they may contact you regarding moving-related services. See Section 5 for the scope of this consent and procedures for revoking it.
With Service Providers
We share information with trusted third-party vendors who assist us in operating our platform, including analytics providers, email and SMS communication platforms, CRM software providers, and website hosting services. These parties are contractually prohibited from using your data for any purpose other than providing services to us.
For Legal Reasons
We may disclose your information when required to do so by law, regulation, court order, or government request, or when we believe disclosure is necessary to protect the rights, property, or safety of IDEAL AGENT®, our users, or the public.
Business Transfers
In the event of a merger, acquisition, sale of assets, or other business transfer involving Lead & Prosper, LLC., your personal information may be transferred as part of that transaction. We will notify you via email or a prominent notice on our Site if such a transfer results in a material change to this Privacy Policy.
We do not sell your personal information. IDEAL AGENT® does not sell, rent, or trade your personal data to third-party marketers or data brokers.
5. Telephone Calls and Text Messages (TCPA Consent and Opt-Out)
When you submit a referral request through IdealAgent.com, you are presented with express written consent language at the point of submission. By providing that consent, you authorize Lead & Prosper, LLC. d/b/a IDEAL AGENT®, the real estate agent matched to your referral, and our designated moving concierge partner Infinity Sales Group to contact you by telephone, including by autodialed and/or prerecorded marketing calls and text messages, at the telephone number you provide, even if that number is registered on a federal or state Do Not Call registry. Consent is not required as a condition of receiving our matching service or any other product or service. Standard message and data rates may apply. Message frequency varies based on your engagement with our service and the active referral process.
How We Use Your Telephone Number
We use the telephone number you provide to:
- Conduct the concierge consultation prior to making your agent match;
- Facilitate contact between you and your matched real estate agent;
- Provide service updates, appointment confirmations, and referral status;
- Send marketing communications related to real estate services for which you have provided consent;
- Facilitate moving-related services through our designated partner Infinity Sales Group, where applicable;
- Verify the accuracy of your submission and prevent fraud.
Recordkeeping
We maintain records of the express written consent you provided at the time of submission, including the exact language displayed to you, the date and time of submission, the IP address from which the submission was made, the version of the consent language then in effect, and the information you entered. These records are retained to demonstrate compliance with the Telephone Consumer Protection Act and other applicable telemarketing laws.
How to Revoke Consent and Stop Receiving Calls or Texts
You may revoke your consent to receive marketing calls and text messages from us at any time and at no cost using either of the following methods:
- Reply “STOP” to any text message you receive from us. You will receive a confirmation message and no further marketing texts from us.
- Contact us using any of the methods listed in the “Contact & Privacy Requests” section of this Privacy Policy and request removal from our calling and texting lists. Please include the telephone number you wish to remove.
We will process your revocation request within a commercially reasonable time, generally not to exceed ten (10) business days. Revocation applies to marketing communications from IDEAL AGENT®. To revoke consent with respect to your matched agent or Infinity Sales Group, you should also contact those parties directly; we will use commercially reasonable efforts to communicate your revocation to network parties, but the matched agent and Infinity Sales Group maintain their own records and opt-out mechanisms. Transactional or service-related messages directly tied to an active referral — such as an appointment confirmation you have requested — may continue unless you separately request that they cease.
Do Not Call Registries
If your telephone number is registered on a federal or state Do Not Call registry, our communications to you are made on the basis of the express written consent you provided through your referral submission. To stop those communications, please use one of the revocation methods set forth above.
6. Data Retention
We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, to comply with legal obligations, resolve disputes, and enforce our agreements. Specific retention considerations include:
- Active referral records: Retained for the duration of your engagement and for a minimum of 5 years following transaction close, consistent with real estate brokerage record-keeping requirements under Florida law.
- Marketing data: Retained until you opt out or request deletion, subject to legal retention requirements.
- Agent profile data: Retained for the duration of the agent’s relationship with IDEAL AGENT® and for a minimum of 3 years following termination.
- Website usage data: Typically retained for up to 26 months in analytics systems.
- TCPA consent records: Retained for a minimum of 5 years following the most recent communication or revocation, consistent with the statute of limitations applicable to TCPA claims.
When data is no longer required, we securely delete or anonymize it.
7. Security of Your Information
We implement commercially reasonable administrative, technical, and physical security measures to protect your personal information from unauthorized access, use, disclosure, alteration, or destruction. These measures include encrypted data transmission (SSL/TLS), access controls, and secure data storage practices.
However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security. In the event of a data breach affecting your rights, we will notify you as required by applicable law.
8. Cookies & Tracking Technologies

9. Third-Party Links

10. Children’s Privacy
Our services are intended solely for individuals who are 18 years of age or older. We do not knowingly collect, use, or disclose personal information from children under the age of 13. If we become aware that we have inadvertently collected personal information from a child under 13, we will promptly delete such information. 11. California Residents — CCPA/CPRA Rights
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), grants you specific rights regarding your personal information:
- Right to Know: You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you, as well as the purposes for which it is used and the categories of third parties with whom it is shared.
- Right to Delete: You have the right to request deletion of your personal information, subject to certain exceptions such as legal obligations or completing transactions.
- Right to Correct: You have the right to request correction of inaccurate personal information we hold about you.
- Right to Opt Out of Sale or Sharing: We do not sell personal information. However, if you wish to opt out of any sharing that may constitute a “sale” or “sharing” for cross-context behavioral advertising under California law, you may do so by contacting us.
- Right to Limit Sensitive Personal Information: As described in Section 2, we do not collect or process sensitive personal information as defined under the CPRA. To the extent applicable, you have the right to limit our use of sensitive personal information to the purposes specified by the CPRA.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.
To exercise any of the above rights, please submit a verifiable consumer request to legal@idealagent.com. We will respond within 45 days of receiving a verifiable request, with a possible extension of an additional 45 days when reasonably necessary. You also have the right to appeal a denial of your request as described in Section 14.
12. Florida Residents
Florida residents may have rights under the Florida Digital Bill of Rights (SB 262) and other applicable Florida privacy laws. These rights may include the right to access, correct, delete, and obtain a copy of personal data we hold about you, as well as the right to opt out of the processing of your personal data for targeted advertising or profiling that produces legal or similarly significant effects.

13. Other U.S. State Privacy Rights
Residents of other U.S. states with comprehensive consumer privacy laws — including but not limited to Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Indiana, Delaware, New Jersey, New Hampshire, Kentucky, Maryland, Minnesota, Rhode Island, and Nebraska — may have one or more of the following rights with respect to their personal data, subject to the specific terms and exceptions of the applicable state law:
- The right to confirm whether we process your personal data and to access that data;
- The right to correct inaccuracies in your personal data;
- The right to delete personal data that we hold about you;
- The right to obtain a portable copy of your personal data;
- The right to opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects;
- The right to opt out of the processing of sensitive personal data, where applicable; and
- The right to appeal a denial of any of the foregoing rights.

14. Right to Appeal
If we decline to take action on a privacy rights request you have submitted, you have the right to appeal our decision. To appeal, please send a written request to legal@idealagent.com with the subject line “Privacy Request Appeal” within sixty (60) days of receiving our decision. Your appeal should include:
- The original request you submitted;
- The decision you are appealing; and
- The basis for your appeal.
We will respond to your appeal within sixty (60) days of receipt, providing a written explanation of the action we have taken and the reasons for that action. If your appeal is denied, you may have the right to contact the attorney general of your state of residence to submit a complaint. We will provide you with the relevant contact information at the time of our written response, where required by applicable law.
15. Do Not Track Signals
Some browsers transmit “Do Not Track” signals to websites. At this time, there is no universally accepted standard for how websites should respond to such signals, and our Site does not currently alter its data collection practices in response to Do Not Track signals. We will reassess this position as industry standards develop.
16. AI & Automated Processing
IDEAL AGENT® may use automated processing and AI-assisted tools to improve our platform, analyze user behavior, and optimize our agent matching process. Automated processing helps identify the most suitable agent matches based on factors such as location, property type, transaction history, and user preferences. No fully automated decision that produces legal or similarly significant effects is made solely on this basis without human review by our concierge team.
We do not use your personal information to train external AI models, and we do not share your data with AI vendors for model training purposes without your explicit consent.
17. Changes to This Privacy Policy
We reserve the right to update or modify this Privacy Policy at any time. When we make material changes, we will update the “Effective Date” at the top of this policy and, where required by law, notify you by email or through a prominent notice on our Site. We encourage you to review this policy periodically.
Your continued use of our Site following any changes constitutes your acceptance of the revised Privacy Policy.
